Terms of Service

1. Agreement
These terms govern your use of Open Markdown (the “app”), a desktop application published by ARALU Single Member P.C. (“we”, “us”). By installing or using the app, you agree to them. If you do not agree, do not use the app.
2. The software and its licence
Open Markdown is free and open-source software, licensed under the GNU General Public License v3.0. The complete source code is available at github.com/ptheofan/open-markdown.
The GPL-3.0 grants you the right to use, study, modify, and redistribute the software under its terms. Where these terms and the GPL-3.0 conflict, the GPL-3.0 prevails in respect of the software itself. Nothing here removes or restricts any right the GPL-3.0 gives you.
3. Your files and your content
The documents you open, edit, and create with the app remain entirely yours. We claim no ownership of, and no licence to, your content. The app runs on your device and never sends your documents anywhere, apart from the optional Google integration described below. (If a document embeds an image hosted on the web, the app fetches that image from its host in order to display it; see our Privacy Policy.)
You are responsible for backing up your work. See section 8.
4. Google account integration
The app offers an optional feature that synchronises a local Markdown file to a Google Doc. This feature is off unless you sign in. If you use it:
- You authorise the app to read and write the Google Docs you select in Google’s file picker, and to upload images to your Google Drive on your behalf. The app is granted access one document at a time, as you pick it, and has no access to the rest of your Drive.
- You confirm you have the right to access and modify those documents.
- Your use of Google services remains subject to Google’s own Terms of Service and privacy policy. We are not affiliated with, endorsed by, or acting for Google.
- Images the app uploads to your Drive to embed in a document are made readable by anyone holding the link. This is described in full in our Privacy Policy — please read it before using the feature.
- You may revoke the app’s access at any time from your Google Account permissions page, or by signing out in the app.
Synchronisation overwrites the linked Google Doc to match your local file. Do not link a document whose contents you cannot afford to lose.
5. Acceptable use
You agree not to use the app to break the law, to infringe anyone’s rights, or to access Google accounts or documents you are not authorised to access.
6. Third-party services
The app can open links you click in your default browser, including a “view in mermaid.live” action for diagrams. Those destinations are operated by others and governed by their own terms. We are not responsible for them.
7. Apple App Store
If you obtained the app from the Mac App Store or TestFlight, the following also applies:
- These terms are concluded between you and us, not with Apple. Apple has no obligation to provide any maintenance or support for the app.
- Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, legal or regulatory compliance, and intellectual-property claims.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
- Your use of the app must also comply with the Apple Media Services Terms and Conditions.
8. No warranty
The app is provided “as is”, without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. This mirrors sections 15 and 16 of the GPL-3.0.
We do not warrant that the app will be uninterrupted, error-free, or that it will not lose or corrupt data. Keep backups of anything that matters.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, nor for any loss of data, profits, or goodwill, arising out of your use of or inability to use the app — including damage to, or loss of, documents in your Google account.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
10. Availability and changes
We may change, suspend, or discontinue the app or any of its features at any time. Because the app is open source, you may continue to use, build, and modify any version you already have under the GPL-3.0.
We may update these terms. Material changes will be published on this page with a revised effective date. Continuing to use the app after a change means you accept the revised terms.
11. Termination
You may stop using the app and uninstall it at any time. Sections 8, 9, and 12 survive termination.
12. Governing law
These terms are governed by the laws of Greece, and the courts of Greece have jurisdiction over any dispute arising from them. If you are a consumer resident elsewhere in the EU, you keep the protection of the mandatory laws of your country of residence.
